CONTRACT CREATION AND ELECTRONIC CONTRACTING

The technical steps required to create the contract between you and us are as follows:

• You place the order for your products on the Website by pressing the confirm order button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website

• You'll need JavaScript enabled on your computer to buy products and check out. Please enable JavaScript in your browser, then refresh your browser to continue. 

• We may send you an order acknowledgement email as soon as you place your order, and you will receive an order confirmation email detailing the Products you have ordered. These emails do not constitute acceptance of your order

• For items being delivered to you, when your product is shipped from our warehouse we will send you a despatch confirmation email

• Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the Products ordered unless we have notified you that we do not accept your order, or you have cancelled it in accordance with the instructions in Change or cancel an order

• For most products sent directly from our warehouse, your credit/debit card will be charged when your order is placed.

• If the product is being delivered directly to you from a supplier, for instance in the case of larger products such as electrical appliances and furniture, you may be charged at any point between confirmation of your order and despatch. The exact timing of this will vary according to supplier and the product you're ordering

Non-acceptance of an order may be a result of one of the following:

• The product you ordered being unavailable from stock

• Our inability to obtain authorisation for your payment

• The identification of a pricing or product description error

• Your not meeting the eligibility to order criteria set out in the main Terms & Conditions

• If you are placing an order for an item that by law is age-restricted, then by clicking the order confirm button you are also confirming to us that you are of at least the legal age required to purchase the product. By clicking the order confirm button, you further acknowledge and consent to us taking steps to verify your age by reference to publicly-available third-party sources.  We reserve the right not to supply any age-restricted product where we reasonably believe that you are below the relevant minimum age. 

• All age-restricted goods must be received by a person who is at least 18 years old at the time of delivery or click & collect handover. We require this regardless of the relevant age limit for the age-restricted product. As an example, age-restricted digital media with an age restriction of 15 can only be given over at the point of delivery handover to an individual who is 18 years old or over.

• We reserve the right to request proof of age identification from you if your order contains age-restricted goods, and we are unsure that you are at least 18 years old at the point of delivery handover. For the delivery or handover of all age-restricted goods, we operate on a Challenge 25 basis, which means that if we think you look under the age of 25, we will ask you to show us proof of age identification. If you are asked for proof of age identification and are unable to provide us with any, we reserve the right to withhold the delivery.

• We reserve the right to limit the number of a given item that can be bought by an individual customer should we deem it appropriate. We also reserve the right to suspend your account and any associated accounts and contact you if we notice an unusual pattern of returns activity or there is other suspicious activity associated with your account or any associated accounts. In the event that this happens you will receive an email not notify you of this

• Should we have taken payment prior to non-acceptance of your Order then we will refund you, but please note that it can take up to 5 to 7 days for the bank to transfer the funds to you

CONSUMER CONTRACTS REGULATIONS 2013

This legislation offers you the following cancellation rights when you buy online:

• You are entitled to cancel your contract if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the goods or services.

• Your right to return or cancel products does not apply to goods that are made to measure or are made to your specification, that have been clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly. This doesn't affect your statutory rights if goods are faulty or not as described.

• If you wish to exercise your right of cancellation, you are obliged to retain possession of the goods and take reasonable care of them.

• To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the order (including order number) you wish to cancel and, where available, your phone number and email address.

• You can cancel by emailing us at support@ya-soko.com.

• If you decide to cancel, you should return the goods to us at your cost within 14 days of such cancellation and we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply. This does not include the cost of delivery or for the supplementary costs arising if you choose a type of delivery other than our standard and least expensive method of delivery 

• We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.

1. Ya-Soko Ltd gift cards and e-gift cards 

2. You can redeem the Ya-Soko Ltd e-gift card online as part or full payment.

3. The following exclusions apply to use of our e-gift card: Ya-Soko Ltd magazine subscriptions, photo printing or software downloads on ya-soko.com.  

4. You cannot use an e-gift card to purchase another e-gift card.

5. Please protect your e-gift card and treat it as cash; we cannot replace lost or stolen e-gift cards.

6. The gift card will expire 12 months from purchase or last use. We will not refund any balance remaining and we will invalidate the card.

7. E-gift cards can be purchased in our online shop with a minimum value of £10. E-gift cards have a maximum value of £500.

8. E-gift cards cannot be exchanged for cash. We do not give change or refunds on e-gift cards.

9. If you are using an e-gift card online and the total order value is less than the value of the card, any balance will remain on the card and may be applied to future purchases, provided that the card has not expired.

10. Where goods you have purchased with a gift card are subsequently exchanged for goods of a lower price or returned, monies owing will be refunded to a gift card.

11. If you return an item bought online using an e-gift card, we’ll refund the amount to an e-gift card. This does not affect your statutory rights.

12. If you place an order at ya-soko.com an e-gift card and subsequently cancel the order before delivery, monies owing will be refunded to your gift card or e-gift card. This does not affect your statutory rights.

13. We reserve the right to refuse to accept an e-gift card which we deem to be tampered with, duplicated or which otherwise is suspected to be affected by fraud.

14. We reserve the right to amend the e-gift card terms and conditions from time to time, where we consider it reasonable and necessary to do so

INTELLECTUAL PROPERTY AND RIGHT TO USE

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.

You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may (if necessary to make a Purchase) download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of the Website is strictly prohibited. WAIVER

No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.

SURVIVAL

Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

ENTIRE AGREEMENT

These Conditions govern our relationship with you. Any changes to these Conditions will be updated on our website. In this way, we can avoid any problems surrounding what Ya-Soko Ltd and you are expected to do. You confirm that, in agreeing to accept the Conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Your Statutory Rights are not affected by these terms and conditions. Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.

LAW

The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.

1. WHO CAN ENTER

1.1 This Competition is open to all residents of the United Kingdom. If you are under the age of 18, you must obtain parental or guardian consent to enter, and they must agree to these Terms and Conditions on your behalf. The Promoter may require any information that we consider reasonably necessary in order to verify your eligibility. 

1.2 By submitting an entry, you are agreeing to be bound by these Terms and Conditions. The instructions provided at the point of entry form part of the Terms and Conditions of this Competition. In the event of a conflict, these Terms and Conditions take precedence. 

1.3 The Competition is free to enter and no purchase is necessary. In some promotions a subscription may be necessary.

2. DEADLINE FOR ENTRIES

2.1. Entries must be received between the start and closing date stated. Entries received after the Closing Date will not be accepted. 

3. HOW TO ENTER

3.1 To enter, simply go to your Ya-Soko Ltd account registered email address to log. Follow the instructions online or in your email or in accordance with the information you received by separate email. 

3.2 There is a limit of one entry per person. Multiple entries submitted directly or with the use of any automated systems will not be entered into the draw. 

3.3 No responsibility will be accepted for entries that are lost, delayed, mislaid or regardless of the cause, including, for example, as a result of any equipment failure, technical malfunction, systems, network, server, computer hardware or software failure of any kind. 

3.4 Those entries not in accordance with the rules will be void and will entitle the Promoter to exclude the entry from the Competition. Any entry containing false, incomplete or misleading information will be void and will entitle the Promoter to exclude the entry from the Competition. 

4. THE PRIZE 

4.1  Prizes are non-transferable, non-refundable and no cash alternative is offered. 

4.2 By participating in the Competition, participants agree that the prize is awarded on an "as is" basis, and that neither the Promoter, nor any of its subsidiary or affiliated companies make any guarantees, representations or warranties of any nature in respect of the prize.

5.3 If you object to any or all of your surname, county and winning entry being published or made available, please contact us at the above email address. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

6. WINNER NOTIFICATION

6.1 The winner will be notified by email as soon as practicable after the prize draw, using the contact details provided with the Competition entry. The winner will be required to respond within 24 hours of notification (unless otherwise stated) confirming their acceptance of the prize. In the event the winner does not respond to communications within this period or if the prize is declined, the Promoter reserves the right to disqualify that winner and draw another winner.  

6.2 The prize will be sent to the winner as soon as reasonably practicable after The Promoter has received a response from the winner, confirming their delivery address.

7. DATA PROTECTION AND PUBLICITY

7.1 By entering the Competition, you understand that for the purposes of administering the Competition and prize fulfilment, it is necessary for the Promoter and the any third parties, to hold and process your personal data:Personal data will only be processed by the Promoter as set out in our privacy policy:

Imperfect or “Flawed” Goods Policy

At YA SOKO, we celebrate the imperfect. Some of our products are sold at a reduced price because they have small flaws, cosmetic marks, or other minor imperfections. As part of our waste reduction, we’re proud to give these items a second chance, and we want to make sure you know exactly what you’re buying.

Before You Buy

• Any known fault or imperfection will be clearly described and/or photographed in the product listing.

• By purchasing an item labelled “imperfect,” “faulty,” “damaged,” “seconds,” “second Hand” or “Flawed,” you acknowledge that you are aware of the described issue and accept the item in its current condition.

• The discount applied reflects the known imperfection.

Product Documentation & Quality Checks

• Every imperfect item is fully inspected and photographed before dispatch to document its condition at the time of sale.

• These records act as our quality reference and will be used to assess any claim of new damage or faults after delivery.

• This ensures full transparency and fairness for both our customers and our team.

Your Rights

Under the Consumer Rights Act 2015, customers are not entitled to a refund for the specific fault or imperfection that was clearly disclosed before purchase.

However, if your item arrives with a new fault or damage not described in the original listing, please contact us within 14 days of receiving your order.

We will review the claim against our documented evidence and product images taken prior to dispatch.

If it is confirmed that the new damage was within our evidence, a refund will be issued as a YA SOKO Gift voucher only.

Refunds Only

• We offer refunds only for verified new faults caused by us.

• We do not offer replacements or repairs for imperfect items.

• Refunds will be processed via the original payment method once the return has been received and reviewed.

Returns of Imperfect Items

• Returns for known or described imperfections are not accepted.

• Returns are only accepted if:

  1. The item has a new, undisclosed fault verified against our pre-dispatch documentation; or

• Please contact us at returns@ya-soko.com before returning any item so we can confirm eligibility of return and issue a return reference.
